اوپک و سازمان جهانی تجارت، تقابل یا تعامل؟ درس‌هایی برای مجمع کشورهای صادرکننده گاز

چکیده

امروزه نفت و گاز به عنوان دو کالای اساسی و مهم در تجارت بین‌الملل مطرح می‌باشند. از آنجا که دو سازمان اصلی در تجارت این دو کالای راهبردی نقش ‌آفرینی می‌نمایند ، تعامل و یا تقابل این دو سازمان در روند این تجارت تأثیرگزار خواهد بود. سازمان کشورهای صادرکننده نفت و سازمان جهانی تجارت  که هرکدام دارای سازوکارهای قانونی و حقوقی مجزی می‌باشند در این راستا نقش آفرینی می‌نمایند. اخیرا نیز مجمع کشورهای صادر کننده گاز نیز به جمع این دو سازمان پیوسته است. در مقاله حاضر ضمن بررسی و ضعیت این دو سازمان  به نقاط تلاقی و   تداخل این دو سازمان با استناد به مقررات سازمان جهانی تجارت اشاره شده است. در این راستا نیز برخی اصول حاکم بر سازمان جهانی تجارت از قبیل محدودیتهای مقداری و حفاظت از محیط زیست و منابع تجدید ناپذیر با ارجاع به  برخی از دعاوی مطروحه در نظام حل و فصل اختلاف سازمان مورد بررسی قرار گرفته است. قابل ذکر است  پیگیری موضوعات مربوط به این کالاها در محاکم داخلی کشورها یا توسل به محاکم بین المللی تاکنون فاقد اثر بوده است. در این باره، رویه رکن حل اختلاف سازمان جهانی تجارت تا کنون پاسخ صریح یا غیر مستقیمی به ادعاهای وارده علیه اقدامات اوپک ارائه نکرده است. از اینرو احتمال می‌رود در آینده‌ای نزدیک این موضوع بطور اساسی و چالشی در سازمان جهانی تجارت مطرح و نهایتا منجر به ایجاد موافقتنامه جدیدی برای پرداختن به آن بشود.
